Judge Juan Carlos Peinado has reactivated proceedings against Begoña Gómez following the Madrid Appeals Court decision that confined the charges to influence peddling and embezzlement.
The magistrate issued an order on Monday granting the prosecution five days to file revised provisional conclusions aligned with the two confirmed offenses. The resolution notes that the judge learned of the Section 23 Appeals Court decision through the press and requested a copy of the ruling received the previous Friday.
Peinado is thus preparing a new order to open oral proceedings that will send the case to the Appeals Court for trial by popular jury. The initial indictment filed by Hazte Oír sought 24 years in prison; it must now be revised to remove the charges of business corruption and misappropriation.
In the same order the judge directed that proceedings concerning businessman Juan Carlos Barrabés be forwarded to the Registration and Distribution Service to continue in another Madrid court. Peinado is scheduled to retire in September.
