On Saturday night, Jose Luna, 59, and his wife Alisett Schubert, 48, attended a party in the Philadelphia area. According to an affidavit, Schubert disrespected Luna in front of others, sparking anger. As they drove home in her silver Nissan Murano, the couple argued.
Near the intersection of Fillmore Street and Huntingdon Pike in Rockledge, a borough in Montgomery County just north of Philadelphia, Schubert told Luna to exit the vehicle and walk home. The two fought over a .38 caliber revolver registered in her name and kept in her purse. Luna gained control of the gun and shot Schubert once. She screamed, "Oh my god!" and attempted to flee the SUV, but he allegedly fired four more times.
A nearby Southeastern Pennsylvania Transportation Authority (SEPTA) bus driver witnessed the event around 10:05 p.m. He reported hearing two or three pops, then saw a man exit the front passenger seat and open the driver's door, causing a woman to fall out. The driver used his emergency system to alert authorities, describing the suspect.
Police arrived to find Schubert on the ground outside the vehicle with multiple gunshot wounds. She was taken to a hospital and pronounced dead. Officers located Luna about one mile away; as they approached, he put the gun to his head and pulled the trigger, but it was out of ammunition. He was arrested.
After the shooting, Luna called Schubert's mother to inform her of her daughter's death and expressed his intent to kill himself, though he did not detail the cause. Court records indicate a history of abuse: Schubert had confided in a friend about physical and mental mistreatment, and the friend once witnessed Luna punch her in the face.
Luna faces charges of first-degree murder, third-degree murder, and prohibited possession of a firearm. He is scheduled for a preliminary hearing on March 5.
