The Fourth Criminal Circuit Court of Neiva declared the criminal action for ideological falsehood extinguished against engineer Erika Fernández Figueroa. The decision was made on July 10, 2026, after eight years of delays in the case over the 2016 collapse of the western stand.
Judge Freddy Peña Ávila closed the preparatory hearing and announced the start of the oral trial for August 3. He kept the charges of embezzlement and improper contract celebration against the project supervisor, but ordered the lifting of precautionary measures for the prescribed offense.
The defense immediately appealed to challenge the co-author status attributed to Fernández Figueroa. The appeal was sent to the Superior Tribunal of Neiva. The file includes 40 million documents, 30 thousand folios and 104 witnesses.
The law requires starting the preparatory hearing within a maximum of 45 days after the accusation filed in 2017. The process accumulated delays due to technical complexity and changes in officials. The Prosecutor's Office maintains that the engineer falsely certified compliance with technical standards.
