Polres Metro Tangerang Kota has suspended the detention of suspect Bahar bin Smith in an alleged assault case, primarily due to his ongoing health recovery from an accident in December 2025. The decision also considers his role as the family breadwinner and teacher to santri, along with guarantees of cooperation from his family. The investigation continues, with case files to be handed over to the prosecutor's office soon.
Bahar bin Smith, also known as Habib Bahar, is the suspect in an alleged assault case handled by Polres Metro Tangerang Kota. His detention was suspended following a request from his legal counsel and an investigation by detectives. Kabid Humas Polda Metro Jaya, Kombes Pol. Budi Hermanto, explained that the suspension is based on the fact that Bahar is undergoing recovery treatment from an accident in December 2025. "Tidak dilakukan penahanan dengan pertimbangan ada fakta tersangka HBS dalam mengalami masa pengobatan pemulihan akibat kecelakaan terjadi Desember 2025," Budi stated on February 15, 2026.
Bahar's medical condition requires outpatient care, confirmed through Polri's medical examination. Kapolres Metro Tangerang Kota, Kombes Raden Muhammad Jauhari, added that detention is a legal authority under the KUHAP, not an obligation for investigators. Other considerations include Bahar's cooperative attitude during the process, his illness with medical records from the collision, and a planned major surgery. "Ini yang saya luruskan nih, bukan satu-satunya tulang punggung keluarga, tapi alasan bahwa yang bersangkutan itu dalam keadaan kondisi sakit... Sehingga melihat kondisi fisik tersebut, ditambah lagi dengan jaminan langsung dari keluarga (ibu, istri) dan kuasa hukum, pertimbangan itu penyidik meng-ACC permohonan tidak dilakukan penahanan," Jauhari said on February 14, 2026.
Bahar's lawyer, Ichwan Tuankotta, stated that after a lengthy examination, the detention was suspended and Bahar has returned home. The request was made citing Bahar's role as the family breadwinner and teacher to santri, accompanied by family guarantees and a commitment to cooperation. Bahar has also issued an apology via video to the victim and GP Ansor organization as a gesture of good faith. The legal team is working to open communication for resolution through restorative justice. Although detention is suspended, the case process continues, with files to be sent to the Prosecutor's Office soon.
