Chairman of DPR RI Commission III, Habiburokhman, has stated that his commission is not intervening in the case of crew members (ABK) from the Sea Dragon Terawa ship carrying nearly 2 tons of methamphetamine at the Batam District Court. Prosecutors from the Batam District Prosecutor's Office (JPU Kejari) are insisting on the death penalty for six defendants, including Fandi Ramadhan, despite criticism from Habiburokhman. He emphasized that the death penalty should be applied selectively in accordance with the Criminal Code (KUHP).
Jakarta, VIVA – During a meeting of DPR RI Commission III on Thursday, February 26, 2026, Chairman Habiburokhman affirmed that his commission is not intervening in the Batam District Court case involving six crew members (ABK) from the Sea Dragon Terawa ship who carried nearly 2 tons of methamphetamine. "We reiterate that we are not intervening in the court," said Habiburokhman in the Commission III DPR RI meeting room at the Parliament Complex, Senayan, Central Jakarta.
Habiburokhman explained that the commission's role is to be accountable to the public for budget allocations to the Supreme Court (MA) and its affiliates, hoping to improve law enforcement in Indonesia. He also stressed that the death penalty is an alternative that must be applied selectively according to the Criminal Code (KUHP). "For the Fandi Ramadhan case, we remind again that the death penalty is an alternative punishment as a last resort that should be applied very selectively as regulated in the KUHP," he stated.
The day before, on Wednesday, February 25, 2026, Prosecutor Muhammad Arfian from the Batam District Prosecutor's Office, in the rebuttal hearing at the Batam District Court, stuck to the death penalty demand read on February 5, 2026. "In principle, we as public prosecutors remain with the indictment that was read on Thursday, February 5, 2026," said Muhammad Arfian. The prosecutors rejected all defense arguments from the defendants and asked the panel of judges to impose the death penalty.
The six defendants include two Thai nationals, Teerapong Lekpradube and Weerepat Phongwan, and four Indonesian citizens (WNI): Fandi Ramadhan, Richard Halomoan, Leo Candra Samosir, and Hasiholan Samosir. Habiburokhman requested the Deputy Attorney General for Supervision to reprimand Muhammad Arfian for allegedly implying intervention by the DPR RI and the public in this case.
