Ngaka Modiri Molema municipality heads to court over R4.6m debt

The Ngaka Modiri Molema District Municipality plans to take legal action to recover R4.6 million from its suspended manager, Allan Losaba. This follows a certificate of debt issued by the Auditor-General last November after overpayments to a water service provider. The municipality has struggled to contact Losaba since his suspension in December.

The Ngaka Modiri Molema District Municipality in South Africa's North West province is preparing to approach the courts to enforce recovery of funds from its suspended municipal manager, Allan Losaba. The Auditor-General issued a R4.6 million certificate of debt against Losaba in November 2025, stemming from his failure to retrieve overpaid amounts to a water tanker service provider.

In December 2025, the municipal council decided to suspend Losaba and appointed Aucharlie Mothupi as acting manager. Efforts to locate and engage Losaba have proven challenging, according to municipal officials.

Executive Mayor Molefe Khumalo stated that Losaba has been uncooperative. "We expected so much, so in some instances we have to seek the services of the sheriff, just so he can see the draft agreement. To date, we have not succeeded in locating him. The option we have is to work on a clear ultimatum from the auditor general, and therefore we have taken the draft settlement agreement to court to make it an order of the court so that we’re able to enforce it," Khumalo said.

This legal step aims to formalize the settlement and ensure compliance with the Auditor-General's directive.
