TSE rapporteur votes against cassation of Jorge Seif

Minister Floriano de Azevedo Marques, rapporteur at the Superior Electoral Court (TSE), voted against the cassation of Senator Jorge Seif's (PL-SC) mandate for alleged abuse of economic power in the 2022 campaign. The judgment was suspended and will resume on Thursday, February 12. The accusations involve benefits from businessman Luciano Hang, owner of Havan.

The TSE judgment on the cassation of Senator Jorge Seif (PL-SC) resumed on Tuesday, February 10, 2024, with rapporteur Minister Floriano de Azevedo Marques voting against it. Seif faces accusations of economic power abuse in the 2022 elections from the Bora Trabalhar Coalition, formed by PSD, Patriota, and União Brasil. In November 2023, the Regional Electoral Court (TRE) of Santa Catarina rejected the claims and upheld the senator's mandate.

The allegations include the use of Havan aircraft and facilities, owned by Luciano Hang, for campaign travel and live social media broadcasts, as well as the businessman's personal involvement. Irregular financing is also cited through participation in a fair by the Sindicato das Indústrias de Calçados de São João Batista (SC) and the use of a helicopter provided by Osni Cipriani. The case also involves Almir Manoel Atanázio dos Santos from the union.

The rapporteur deemed the evidence insufficient to establish abuse. “Without robust proof, the popular vote must be privileged,” Marques stated. He noted a “gray area” around the air transport but pointed out the lack of passenger lists due to private flights and elapsed time. Criticisms were directed at the TRE-SC process for omissions that may have resulted in lost evidence, such as electronic data and witnesses.

The case had been suspended since the first semester of 2024, following postponements and new diligences ordered in April to gather information from airfields on Havan aircraft from January 2022 to March 2023. Seif's defense argued there is no proof of abuse or significant involvement by Hang. Political maneuvers in Congress sought to absolve the senator, a Jair Bolsonaro ally, including support from Rodrigo Pacheco (PSD-MG) and Tarcísio de Freitas (Republicanos).

Six ministers' votes remain, and the judgment continues on Thursday, February 12.

STF Minister Gilmar Mendes suspended parts of the 1950 Impeachment Law, restricting impeachment requests for ministers to only the PGR and raising the required Senate quorum. The move prompted an immediate reaction from Senate President Davi Alcolumbre, who defended the Legislature's prerogatives and threatened constitutional changes. The Lula government, through the AGU, requested reconsideration until plenary judgment.

The Supreme Federal Court's First Panel unanimously rejected Jair Bolsonaro's defense appeal on Friday (7) in the coup plot case, upholding his 27-year prison sentence. Allies of the former president, including Senator Flávio Bolsonaro and PL president Valdemar Costa Neto, reacted at the inauguration of a party headquarters in Atibaia, vowing responses to alleged persecution and betting on Bolsonaro's return to the presidency in 2026. Defenses of other defendants, like Walter Braga Netto, announced appeals including to international courts.

The Superior Court of Justice (STJ) unanimously denied an appeal by businessman Luciano Hang, owner of Havan, in a case against Folha de S.Paulo and reporter Patrícia Campos Mello. The ruling upholds the Santa Catarina Court of Justice's decision, which rejected a damages claim linked to a 2018 report on mass WhatsApp messages during the elections.

The Chamber of Deputies unanimously approved the admissibility of the constitutional accusation against suspended Supreme Court Justice Diego Simpértegui, with 132 votes in favor. The libel, pushed by ruling-party deputies, is based on three chapters regarding breaches of probity in key judicial cases. The Senate will now decide the case on December 22, potentially removing him from office if approved by a majority.

STF Justice André Mendonça ordered greater transparency in the Banco Master case by mandating the delivery of ex-banker Daniel Vorcaro's data to the INSS CPI and the Federal Police. The ruling makes Vorcaro's attendance at the commission optional and reduces risks of evidence tampering. Meanwhile, reports of parties hosted by Vorcaro with authorities heighten suspicions of undue influence in power structures.

Centrist leaders in Brazil's lower house want to avoid voting on a bill regulating extra perks and supersalaries for public servants unless President Lula's government engages directly. The Supreme Federal Court suspended these benefits and ordered Congress to legislate within 60 days, but the deadline is deemed too short in an election year. The STF plenary is judging the decisions this week.

The review commission of the Chamber of Deputies unusually annulled the unanimous vote approving the constitutional accusation against Supreme Court Judge Diego Simpértegui due to an error in delivering key documents. Commission President Maite Orsini decided to repeat the vote on Thursday after confirming that a crucial piece of evidence arrived on time but was not reported. This postpones the plenary session until next Monday.
