Toesca AGF filed a third complaint against former Sartor AGF directors over the financing scheme used to acquire control of Azul Azul S.A., the concessionaire of Club Universidad de Chile. The lawsuit details promissory notes and transfers worth billions of pesos between 2021 and 2024.
The complaint filed Monday by Toesca AGF, as liquidator of the failed Sartor AGF funds, accuses Pedro Pablo Larraín Mery, Michael Clark and other former directors of incompatible negotiation and disloyal administration.
According to the filing, the Leasing, Táctico and Proyección funds channeled resources through Inversiones Cerro El Plomo SpA to pay Carlos Heller in 2021, without real contributions from participants. Promissory notes for $3.276 billion and $3.900 billion were issued, along with refinancing of the Banco Santander credit.
The lawsuit also references the “bono bulla” of UF400,000 issued by Azul Azul in 2022 and the December 2024 purchase of Tactical Sport Fund quotas by Inversiones Antumalal Limitada without cash payment. Clark, who simultaneously served as Sartor AGF director and Azul Azul chairman, faces conflict-of-interest claims.
This new legal step follows the Monday raid on Azul Azul offices and Clark’s home, authorized by Santiago’s Fourth Guarantee Court as part of the criminal investigation.
