Rodrigo Bacellar leaves prison in Rio after Moraes' decision

State deputy Rodrigo Bacellar (União Brasil) was released from prison on the night of December 9, 2025, after Supreme Court Justice Alexandre de Moraes replaced preventive detention with precautionary measures, including an electronic ankle monitor.

Rodrigo Bacellar, president of the Rio de Janeiro Legislative Assembly (Alerj) for União Brasil, was arrested on December 3, 2025, by the Federal Police during Operation Unha e Carne. The operation investigates the leak of classified information about Operation Zargun, launched in September and leading to the arrest of former deputy TH Joias, accused of brokering arms purchases and sales for the Comando Vermelho.

Bacellar's defense claims he is innocent and denies any attempt to interfere in investigations, stating that the deputy 'did not engage in conduct that constitutes obstruction'.

On December 8, Alerj voted to revoke the preventive detention, with 42 votes in favor, 21 against, two abstentions, and four absences, exceeding the required minimum of 36 votes. The assembly relied on Article 53 of the Federal Constitution, which protects lawmakers from arrests during their term, except in flagrante delicto of non-bailable crimes.

On the night of December 9, Supreme Court Justice Alexandre de Moraes authorized the release but imposed precautionary measures: removal from the Alerj presidency; use of an electronic ankle monitor; nightly home confinement from 7 p.m. to 6 a.m., and full confinement on weekends and holidays; prohibition of contact with other investigated parties; surrender of all passports; and suspension of gun permit. Non-compliance incurs a daily fine of R$ 50,000.

Bacellar left the Federal Police headquarters in Rio in an unmarked vehicle and had the ankle monitor installed by the Penitentiary Administration Secretariat (Seap) at 7:10 p.m., after a body examination. Seap will monitor the device and send daily reports to the STF.
