Maricarmen eviction postponed again until September 23

A Madrid court has postponed for the third time the eviction of Maricarmen, an 87-year-old woman who has lived for seven decades in her home in the Retiro district. The new date set is September 23, 2026.

Madrid court number 90 upheld the appeal filed by Maricarmen’s lawyer, Beatriz Duro. The second postponement did not respect the minimum one-month period required by Article 704 of the Civil Procedure Law for evictions from a habitual residence.

The Tenants’ Union of Madrid notes that the court did not address the request from the UN Committee on Economic, Social and Cultural Rights to suspend the procedure until public administrations provide a housing alternative. Planned support events have been moved to September 22.

Maricarmen faces the third eviction attempt promoted by the real estate company Urbagestión, which sought to triple her rent. The union submitted a dossier with proposals to the Ministry of Housing last October, but neither the Madrid City Council nor the regional government has responded to requests for a housing alternative.
