The image depicts a woman wielding a whip in an attacking pose, linked to Ana Paula, beside a handcuffed man representing Matheus, with political captions like “black right-winger” and “white left-winger.” The notification, signed by lawyer Roberto Montanari Custódio, states that the post attributes violent and racist conduct to the communicator, invoking symbols of slavery and torture, thus violating her image rights and honor under Article 5, Clause X of the Federal Constitution and Article 20 of the Civil Code.

The document demands that Matheus issue a public retraction across all his social media, including feed and stories, within one hour, acknowledging the mistake and apologizing to Ana Paula and the public. Failure to comply could lead to lawsuits for moral damages, obligations to act, and charges of injury and defamation under Articles 140 and 139 of the Penal Code. The post has been preserved as evidence.

Matheus responded on social media, stating he shared the montage alongside an apology video to content creator @LiviaZaruty and misinterpreted it as posted by a fan. He emphasized there was no intent to attack Ana Paula. The image's creator, in a video shared by Matheus, clarified that the artwork symbolized white people trying to “teach” blackness to Black individuals, without direct ties to the parties involved.
