बोस्टन की संघीय अदालत ने सोमवार को राष्ट्रपति डोनाल्ड ट्रंप द्वारा नए H-1B वीजा आवेदनों पर 1 लाख डॉलर की फीस लगाने की योजना को गैरकानूनी करार दिया। न्यायाधीश लियो सोरोकिन ने इसे कांग्रेस द्वारा अधिकृत नहीं करार दिया।

मैसाचुसेट्स के बोस्टन स्थित अमेरिकी जिला न्यायालय के न्यायाधीश लियो सोरोकिन ने यह फैसला 20 डेमोक्रेटिक राज्यों के अटॉर्नी जनरल द्वारा दायर मुकदमे में सुनाया। ट्रंप प्रशासन ने पिछले साल सितंबर में यह शुल्क प्रस्तावित किया था।

अदालत ने कहा कि सामान्य H-1B शुल्क 2,000 से 5,000 डॉलर के बीच था और नया शुल्क कांग्रेस की अनुमति के बिना कर के रूप में लगाया गया। याचिकाकर्ताओं ने तर्क दिया कि प्रशासन के पास ऐसा शुल्क लगाने का अधिकार नहीं है।

H-1B वीजा कार्यक्रम भारतीय पेशेवरों और आईटी कंपनियों द्वारा सबसे अधिक उपयोग किया जाता है। अदालत के इस फैसले को भारतीय पेशेवरों के लिए राहत के रूप में देखा जा रहा है।
