Court stops planned sale of Embraer aircraft in Abuja

A High Court in Nigeria's Federal Capital Territory has issued an interim order blocking the sale of an Embraer aircraft amid allegations of unpaid dues. The ruling came after an ex parte application by a construction firm claiming ownership rights. Defendants must now justify their actions within seven days.

On Friday, December 5, 2025, Justice M. A. Madugu of the High Court of the Federal Capital Territory, sitting in Bwari, granted an ex parte motion filed by Reekers Engineering and Construction Limited. The suit, marked FCT/HC/BW/CV/391/2025, targets Galactic Aviation Limited, Mr. Abdullahi Ahmed, NG Eagle Airline Limited, and the Honourable Minister for Aviation and Aerospace Development as the first through fourth respondents.

The court's interim order specifically restrains the first three defendants—Galactic Aviation Limited, Mr. Abdullahi Ahmed, and NG Eagle Airline Limited—from selling or offering for sale the Embraer EMB-145LR aircraft registered as 5N-BZM. This aircraft bears Manufacturer Serial Number 14500842, with engine serial numbers ESN 25606 and ESN 25831. The claimant, represented by Senior Advocate of Nigeria Mr. Azeez Taiwo Hassan, argued that the defendants had not fully paid for the aircraft.

Justice Madugu ordered the defendants to appear within seven days to show cause why the claimant's key prayers should not be granted. The matter has been adjourned to December 16, 2026, for further hearing.

This development highlights ongoing disputes in Nigeria's aviation sector, where financial obligations and asset ownership remain contentious. Reekers Engineering and Construction Limited seeks to protect its interests in the aircraft, preventing any transfer until the court resolves the payment allegations.
