The Civil and Criminal Chamber of the Superior Court of Justice of Castilla y León has acquitted a man previously convicted of assaulting Carlos Martínez, former mayor of Soria, in 2023.
The court revoked the sentence from the Provincial Court of Soria by applying the in dubio pro reo principle. The judges found insufficient evidence to identify the perpetrator due to contradictions in witness statements and mismatches in details such as height and clothing.
The incident took place on June 11, 2023, in a bar on Plaza Mayor during the Lavalenguas festivities. The original conviction carried one year and three months in prison for assault on authority and minor injuries, plus 240 euros in compensation.
The new ruling is not final and an appeal to the Supreme Court is possible. The tribunal noted that the facts of the complaint are accepted as true, but authorship cannot be attributed to the accused beyond reasonable doubt.
