Tesla and driver sued over fatal Texas crash

The family of a woman killed in a Texas crash has sued Tesla and the driver of a Model 3. The suit alleges negligence and a design defect. Tesla maintains the driver overrode the vehicle's automated systems.

The lawsuit was filed by the daughter and husband of 76-year-old Martha Avila. It targets Tesla and driver Michael Butler over the crash in Katy, Texas.

Butler told authorities the vehicle was operating with an automated driving assistance system engaged. The Harris County Sheriff’s Office confirmed he showed no signs of intoxication.

Tesla CEO Elon Musk and Head of AI Ashok Elluswamy stated that company data showed Butler pressed the accelerator pedal to 100 percent. The vehicle reached 73 miles per hour, and the pedal remained compressed after impact.

The complaint references prior incidents involving Tesla Autopilot. It does not detail the precise location or conditions of the crash beyond the residential area.
