Ngaka Modiri Molema municipality heads to court over R4.6m debt

The Ngaka Modiri Molema District Municipality plans to take legal action to recover R4.6 million from its suspended manager, Allan Losaba. This follows a certificate of debt issued by the Auditor-General last November after overpayments to a water service provider. The municipality has struggled to contact Losaba since his suspension in December.

The Ngaka Modiri Molema District Municipality in South Africa's North West province is preparing to approach the courts to enforce recovery of funds from its suspended municipal manager, Allan Losaba. The Auditor-General issued a R4.6 million certificate of debt against Losaba in November 2025, stemming from his failure to retrieve overpaid amounts to a water tanker service provider.

In December 2025, the municipal council decided to suspend Losaba and appointed Aucharlie Mothupi as acting manager. Efforts to locate and engage Losaba have proven challenging, according to municipal officials.

Executive Mayor Molefe Khumalo stated that Losaba has been uncooperative. "We expected so much, so in some instances we have to seek the services of the sheriff, just so he can see the draft agreement. To date, we have not succeeded in locating him. The option we have is to work on a clear ultimatum from the auditor general, and therefore we have taken the draft settlement agreement to court to make it an order of the court so that we’re able to enforce it," Khumalo said.

This legal step aims to formalize the settlement and ensure compliance with the Auditor-General's directive.

ActionSA has suspended City of Tshwane councillor and Corporate and Shared Services MMC Kholofelo Morodi as a party member pending a preliminary investigation into Madlanga Commission allegations. Tshwane Mayor Nasiphi Moya earlier placed her on special leave after evidence allegedly showed her sharing internal land lease tender documents with police sergeant Fannie Nkosi. The moves aim to uphold transparency and accountability.

Nelson Mandela Bay metro is struggling with a leadership vacuum, relying on acting managers beyond legal limits and incurring millions in costs, opposition parties say. The crisis has led to lost funds and service delivery issues, highlighted during a recent parliamentary committee appearance. The DA has lodged a criminal complaint against Mayor Babalwa Lobishe for allegedly misleading Parliament.

A South African court has dismissed an urgent interdict sought by Nelson Mandela Bay mayor Babalwa Lobishe against former Good party regional chairman Siyanda Mayana, who accused her of illegal activities. Mayana claims he faces intimidation from ANC officials amid an ongoing Hawks investigation into her finances. The ruling allows Mayana to continue his public criticisms without legal restraint for now.

Nelson Mandela Bay mayor Babalwa Lobishe has accused fellow ANC members of plotting to undermine her leadership, amid an escalating scandal over a controversial R25-million transformer lease and probes into her bank deposits. This follows opposition accusations and a court ruling allowing critics to continue, with provincial ANC leaders warning that internal rifts threaten service delivery before local elections. The party has tasked its integrity commission with investigating.

Parliament’s Cooperative Governance and Traditional Affairs committee has warned the Nelson Mandela Bay Metro it may take further steps due to delayed responses to post-oversight requests. The concerns stem from an October 2025 oversight visit involving multiple municipalities. The metro maintains it submitted the required report on 14 March 2026.

The sudden resignation of Ekurhuleni's finance committee member Jongizizwe Dlabathi has left the municipality's R51-billion budget in limbo, just weeks before it was due to be tabled. The move follows Mayor Nkosindiphile Xhakaza's recent reshuffle that reduced the EFF's positions and prompted their withdrawal from the coalition. This has plunged the metro into deeper political uncertainty.
