The High Court has canceled the appointment of former Minister Aisha Jumwa as chairperson of the Kenya Roads Board. The ruling found that the selection process violated the law and constitution.
The court ruled the appointment unconstitutional and void from the start. It rejected the government's argument that Jumwa had first been selected by the Kenya Transport Association before President Ruto named her chairperson.
The appointments appeared in Gazette Notice Number 384 on January 16, 2025 as a board member and Number 395 on January 17, 2025 as chairperson. The court stressed that the law requires selection from recognized bodies such as the Institution of Engineers of Kenya and the Kenya Transport Association.
The case was filed by activist Francis Awino along with the Law Society of Kenya and Patrick Njuguna. The court directed that any new appointment must fully comply with the Kenya Roads Board Act and Articles 10, 47 and 232 of the 2010 Constitution.
