The Administrative Tribunal of Huila ordered the immediate suspension of Cristian Renato González Pérez as Neiva Comptroller on June 4 due to ineligibility. The official appealed to the Council of State and remains in office while the Municipal Council delays appointing an interim replacement.
González Pérez stated that he complies with the precautionary measure but maintains his absolute dissent. He noted that the tribunal made an interpretation error by linking his previous role at the Hospital Universitario de Neiva, a departmental entity, with the municipal comptroller's office.
The defense filed an appeal based on Constitutional Court sentence SU-566 of 2019. It argued there is no jurisdictional overlap or risk of overseeing his own prior management.
The Neiva Council issued a statement on June 9 expressing respect for the judicial order but announced a comprehensive analysis before acting. So far it has not declared the vacancy or appointed an interim official, despite the law requiring immediate compliance.
González Pérez estimated that the Council of State will resolve the case within one to one and a half months. Meanwhile, any act he signs could be declared null for lack of legal authority.
