The Centre told the Delhi high court that it will not take immediate possession of the Delhi Gymkhana Club following its May 22 notice. Any further action will follow due process and prior notice. The court issued summons but declined interim directions.
The Centre informed the Delhi high court on Tuesday that its May 22 notice to the Delhi Gymkhana Club invoked Clause 4 of the lease deed for re-entry on public purpose grounds. The notice directed the club at 2, Safdarjung Road to vacate by June 5 to strengthen defence infrastructure in a sensitive area.
Solicitor general Tushar Mehta stated that any eviction would require prior notice and follow the law. He noted that the club’s governing body had itself written to authorities on May 25 raising concerns.
Justice Avneesh Jhingan observed that the Centre’s assurances addressed apprehensions about forcible eviction or handover by nominees. The suit filed by member Vijay Khurana and others will next be heard on July 28.
