Delhi court grants bail to Shabir Shah in terror funding case

A Delhi court on Saturday granted bail to Shabir Shah, leader of the Jammu Kashmir Democratic Freedom Party (JKDFP), in an alleged terror funding case filed by the Enforcement Directorate (ED). The decision follows the Supreme Court's bail order dated March 12, 2026.

Special NIA Judge Prashant Sharma at Patiala House Court granted bail to Shabir Ahmad Shah. In his order, the judge stated, “It is an admitted position that accused Shabir Ahmad Shah was granted bail by Hon’ble Apex Court in predicate offence, vide order dated 12.03.2026, in SLP (Crl.) No. 13399/2025. It is also an admitted position that said the accused was not arrested by ED during investigation in this case and complaint against him was filed by ED, without arresting him.”

The judge added, “…Once, the accused is not arrested by ED and the said accused appears before this court on being summoned, then … bail has to be granted to the accused.”

Shah has been named in at least 24 FIRs, including allegations of terror funding, rioting with a deadly weapon, promoting enmity between groups on grounds of religion, and being part of an unlawful assembly at a polling station. The NIA arrested him from his Srinagar residence in 2017 and handed him over to the ED. The main cases against him are two terror cases under the UAPA lodged by the NIA. The Supreme Court had granted bail noting his prolonged incarceration.
