Valencia court acquits 'El Jincho' citing reasonable doubt in sexual assault case

The Fourth Section of the Valencia Provincial Court has acquitted rappers El Jincho and Osiris The Enemy of sexual assault against a minor. The court identified contradictions in the complainant's account and elements that create reasonable doubt.

The court acquitted David Calvo, known as El Jincho, and Escol Osiris Reyes, known as Osiris The Enemy. Both had been charged following a concert held on October 4, 2023 in Mislata.

The ruling highlights contradictions between the victim's statements to the police and to forensic experts regarding the location of the incidents at a Valencia hotel. It also considers the testimony of the complainant's friend, who stated she witnessed no rape, and security camera footage showing no signs of coercion.

The hotel receptionist testified that the minor had a normal interaction and did not seek help. The court noted that it cannot be concluded the accused knew she was a minor. The sentence is not final and an appeal is possible.
