The Puerto Montt Court of Appeals annulled the hearing scheduled to review Senator Miguel Ángel Calisto's desafuero after the Coyhaique Guarantee Court reopened the investigation.
The Los Lagos Appeals Court made the decision on July 9, ruling that the desafuero request filed by regional prosecutor Hernán Libedinsky had lost validity. This followed the Coyhaique Guarantee Court's July 7 order to reopen the investigation for 60 days.
Senator Calisto's defense team, led by lawyers Jorge Bofill and César Ramos, had requested the hearing be suspended. The Prosecutor's Office and the State Defense Council opposed the move, but the court sided with the defense by a two-to-one vote.
Calisto, who faces a request for 12 years in prison for repeated fraud against the Fisco, said he will resume his congressional duties. The senator maintains an inapplicability appeal before the Constitutional Court.
