OAB-TO contacts CNJ after judge threatens to fine lawyer for AI use

The Brazilian Bar Association in Tocantins contacted the National Council of Justice after a judge announced fines for the use of artificial intelligence in court cases.

During the June 3 session of the 1st Civil Chamber of the Tocantins Court of Justice, Judge Adolfo Amaro Mendes warned a lawyer about the use of AI. He stated that a false jurisprudence citation attributed to the Superior Court of Justice had been identified.

Mendes said he would start punishing the party and, jointly, the lawyer. “We will not cite anything that could lead the judge into error,” he said.

OAB-TO president Gedeon Pitaluga released a video expressing concern. He noted that the Bar Association has exclusive competence over lawyers’ ethical conduct and that there is no legal basis for joint punishment for bad-faith litigation.
