Italian magistrates stressed that judging functions must be assigned to a third party free from personal interests. They deemed Moraes's involvement a macroscopic violation of the right to defense and the principle of impartiality.
In a statement issued on June 12, 2026, Supreme Federal Court President Luiz Edson Fachin reaffirmed the STF's independence and impartiality. Fachin said the proceedings in Criminal Action 2428/DF followed the Constitution and due process, with the conviction unanimously upheld by the First Panel.
