Braga proposes opening energy market to small consumers

Senator Eduardo Braga included in his proposal for Provisional Measure 1.304/2024 the opening of the energy market to low-voltage consumers, such as homes and small businesses. The vote on the report was postponed to Wednesday (29/10), with a final approval deadline of November 7. If approved, the measure will allow free choice of suppliers from 2028.

Provisional Measure (MP) 1.304/2024, addressing the electricity sector, received a significant amendment proposed by Senator Eduardo Braga (MDB-AM), the rapporteur in the joint congressional committee. Braga included the opening of the free energy market to low-voltage consumers, covering homes, small businesses, and small industries. Currently, this market is limited to large consumers, such as major industrial companies, shopping malls, and hospitals with high continuous consumption.

The joint committee, made up of deputies and senators, postponed the vote on the report on Tuesday (28/10) after a request for further review, allowing more time for analysis. The vote is set to resume on Wednesday (29/10). The text requires approval in the full sessions of the Chamber of Deputies and the Senate by November 7, when the MP expires.

If President Luiz Inácio Lula da Silva (PT) sanctions the measure in 2025, from 2028 all consumers will be able to freely choose their suppliers and the type of energy they want. For industries and businesses, this freedom could take effect as early as 2027. In practice, this will allow users to switch from local distributors, such as Neoenergia in the Federal District or Enel in São Paulo, to any marketer for more advantageous rates.

This change aims to democratize access to the energy market, benefiting small consumers with more competitive options.
