Medscheme has withdrawn its legal application against Bonitas Medical Fund. The decision allows the Council for Medical Schemes to proceed with a forensic investigation into allegations of improper procurement. No findings of wrongdoing have been made against any party.
Medscheme launched the application after alleging evidence of significant impropriety in tender processes for Bonitas’s BonCap option and marketing contracts. The company claimed contracts went to entities lacking required experience and compliance credentials. Those allegations remain untested in court.
Bonitas awarded its administration contract to Momentum Health and its managed-care contract to Private Health Administrators. The new arrangements began on 1 June after Medscheme’s contracts ended on 31 May.
In an affidavit filed in January, Bonitas principal officer Lee Callakoppen argued there was no link between earlier tenders and the recent contracts. He said the later processes were complete with binding agreements signed. The Council for Medical Schemes opened a Section 43 enquiry in February 2025 and resolved in November 2025 to start a forensic investigation.
