The process follows Paragraph 15 of the Election Symbols Order, 1968. Each faction must provide documents on organisational structure and legislative support. The commission may recognise one faction, freeze the symbol or recognise both groups as separate parties.

A senior ECI official said both sides will receive full opportunity to present evidence before any decision. The twin-flower symbol is expected to remain frozen until the verdict. A related hearing at the Calcutta High Court is scheduled for July 28.
