On 10 July 2026 the Madlanga Commission heard evidence that advocate Andrea Johnson sent details of a confidential assault complaint to the accused officer in 2018.
A Crime Intelligence officer testifying as Witness O told the Commission that on 4 July 2018 she received and printed an email from a Gmail address named Andrea Johnson. The message contained 12 JPEG images and an audio file of Brigadier Lenora Phetlhe’s A1 statement and J88 medical report. The officer said she had been instructed to delete the email after printing but kept it instead.
Retired Hawks Colonel Kobus Roelofse testified that Major-General Feroz Khan received the complaint documents before submitting his own warning statement. Roelofse described the timing as concerning because it could allow the suspect to tailor his version of events.
The Commission also heard that the email had first been sent by then-journalist Barry Bateman to Johnson on 3 July 2018. The National Prosecuting Authority decided not to prosecute the case against Khan on 15 December 2021.
