The new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP) take effect on Friday, January 2, 2026. These laws were passed years ago and have been prepared for implementation by the government. Law enforcement officials are stated to be ready for this change.
The KUHP was passed in a DPR RI plenary session on December 6, 2022, and signed by President Joko Widodo on January 2, 2023, with an effective date three years later. Meanwhile, the KUHAP was passed in the 8th DPR RI plenary session of the second period of the 2025-2026 session year on November 18, 2025, at the Parliamentary Complex in Senayan, Central Jakarta.
DPR RI Speaker Puan Maharani stated that the new KUHAP will take effect on January 2, 2026. "This law will take effect on January 2, 2026," said Puan to reporters.
The government ensures law enforcement readiness through the issuance of implementing regulations. Deputy Minister of Law and Human Rights Edward Omar Sharif Hiariej revealed that three implementing regulations have been prepared for the KUHP and three for the KUHAP. "Law enforcement officials are ready and the government has prepared 3 Implementing Regulations for the KUHP and three Implementing Regulations for the KUHAP," said Eddy during the signing of a memorandum of understanding between Polri and the Attorney General's Office at the Bareskrim Polri Building in Jakarta on December 16, 2025.
These regulations include the Government Regulation on KUHP Implementation, Government Regulation on Restorative Justice Mechanisms, and Presidential Regulation on Information Technology-Based Criminal Justice System. Two have been harmonized, and the others will be finalized before January 2, 2026. The existence of these derivative rules is expected to eliminate public doubts about law enforcers' readiness. "Along with the new KUHP and KUHAP so there is no more doubt that law enforcement officials are not ready. But once again, I emphasize that our law enforcement officials are ready to welcome the new KUHP and KUHAP," Eddy stressed.
