NPA welcomes dismissal of Shebe Maburna's bail appeal

The National Prosecuting Authority in Limpopo has welcomed a High Court ruling that dismissed musician Shebe Maburna's urgent bail appeal. Maburna, whose real name is Lehlohonolo Chauke, faces multiple serious charges including attempted murder. The court found no exceptional circumstances to justify his release.

The Polokwane High Court has dismissed an urgent bail appeal by South African artist Lehlohonolo Chauke, known professionally as Shebe Maburna. This follows the Polokwane Magistrate’s Court denying him bail last month. Maburna is charged with more than eight counts, including three of attempted murder.

Acting Judge Natalie Burnett ruled that, despite Maburna's status as a popular musician with many fans, there was no exceptional evidence warranting his release on bail. The National Prosecuting Authority (NPA) in Limpopo opposed the bail at both the magistrate's court and high court levels.

Limpopo NPA spokesperson Mashudu Malabi expressed satisfaction with the decision. “We welcome the dismissal of bail appeal regarding the matter of Shebe Maburna because even in the Polokwane Magistrate’s Court, we were opposing bail, as he’s facing more than eight charges and on those counts, we have three counts of attempted murder, even when it comes to the high court, we are still welcoming that it has been dismissed,” Malabi stated.

This ruling underscores the seriousness of the charges against Maburna and the judiciary's stance on bail in cases involving violent crimes. The case highlights ongoing legal proceedings in Limpopo, where the NPA continues to prioritize public safety in its prosecutions.

South Africa's Constitutional Court has ruled that the extradition of Moroadi Cholota from the United States was unlawful, but her prosecution must proceed. The decision clarifies that the National Prosecuting Authority lacks the power to request extraditions, assigning that role to the national executive. This ruling provides a lifeline to ongoing cases while addressing long-standing legal practices.

Advocate Andy Mothibi, the new head of South Africa's National Prosecuting Authority, has dismissed concerns over his appointment as flawed. Civic groups and political parties question the selection process, but Mothibi insists he is concentrating on rebuilding trust in the institution.
