A Neiva judge sentenced Gildardo Burbano Chito to 21 years in prison for sexually abusing a girl over four years in rural Aipe, Huila. The assaults began when the victim was six and were silenced with death threats against her siblings. The ruling relied on testimonies, forensic evidence, and the girl's statement.
Gildardo Burbano Chito, 34, sexually abused a minor in vereda La Estrella, Santa Rita corregimiento, Aipe municipality, from October 2018 to December 2022. The prosecutor detailed that the acts began with lewd touchings when the girl was six and escalated to abusive carnal access until she was ten. The aggressor took advantage of the mother's absence, who traveled to Neiva, to commit the assaults, covering her mouth and threatening to harm her siblings.
"It is evident the chronological and systematized sexual violence suffered by the minor", the prosecutor said during the trial. The girl recounted that Burbano Chito tied her, inserted fingers into her vagina, and sometimes attempted penile access, causing her pain. The abuses also occurred in a field near the aggressor's horse and in an aunt's house in Neiva, where he showed her explicit videos.
Exhausted by the assaults, the minor confided in an aunt. The Second Penal Circuit Judge of Neiva deemed the victim's testimony "coherent, persistent over time, and detailed", supported by a forensic interview and the father's statements confirming psychological treatments for the girl.
The judge found him guilty of aggravated violent carnal access, aggravated abusive carnal access with a minor under 14, and aggravated sexual acts with a minor under 14, imposing a 21-year prison sentence.
