Eduardo Bolsonaro (PL), who resides in the United States, was announced as the first alternate for André do Prado (PL), the Senate pre-candidate. Brazilian law permits the candidacy despite his residence abroad, experts confirm.
The former federal deputy had his mandate revoked in December due to excessive absences. He joins the ticket led by Flávio Bolsonaro (PL), pre-candidate for the Presidency, and Tarcísio de Freitas (Republicans), running for re-election as São Paulo governor with Felício Ramuth (MDB) as vice. Guilherme Derrite (PP) is the other Senate pre-candidate.
The Supreme Federal Court formalized on February 19 of this year the criminal action against Eduardo for obstruction of justice and coercion. The Federal Prosecution Service complaint alleges that he acted in the US to impose sanctions on Brazilian authorities and tariffs against Brazil, following President Donald Trump's determination in April 2025.
Electoral law experts consulted by Metrópoles state there is no legal barrier to remote campaigning, as civil and electoral domicile rules differ. However, a conviction before the October elections would subject him to the Clean Record Law, resulting in eight years of ineligibility and requiring a ticket substitution up to 20 days before the first round.
