Bombay High Court says marital discord alone not enough for abetment charge

The Bombay High Court's Nagpur bench held in an order passed last week that matrimonial discord is common in domestic life and suicide cannot be attributed to either spouse merely because of a matrimonial dispute.

The court added that there has to be instigation or direct incitement from the accused to the victim to end their life. This ruling quashed a suicide case from 2019 in Amravati.

The judgment emphasizes mens rea in abetment cases and references a suicide note, setting a precedent for legal proceedings involving domestic disputes.
