A judge in Neiva sentenced Flor Escilda Poche Cuentocue and Wilson Javier López Ducuara to 19 years and 2 months in prison for sexual acts with a 12-year-old girl and commercial sexual exploitation. The events took place in 2018, when the minor was lured to the city with promises of material goods. The ruling relies on the victim's coherent testimony and evidence from the prosecutor's office.
In August 2018, a 12-year-old girl became a victim of sexual abuse in Neiva, Huila. The minor's grandmother reported the incidents on August 5 to the 15th Sectional Prosecutor's Office, attached to the Comprehensive Care Center for Victims of Sexual Violence (Caivas). The investigation showed that Flor Escilda Poche Cuentocue convinced the girl to travel to Neiva without telling her family, promising education, a cell phone, television, and housing in exchange for relations with her husband, Wilson Javier López Ducuara.
The key incident happened on August 4 in a house in the Luis Ignacio Andrade neighborhood. After leaving the shower, the girl entered her room, but Flor Escilda prevented her from locking the door. Wilson Javier entered, pushed her onto the bed, kissed her neck, and touched her breasts. The girl struggled and fled to a neighbor's house, who called the police.
During her stay in a hotel, a farm, and the mentioned house, the victim described groping of her breasts and buttocks by Wilson, while Flor Escilda downplayed the acts, saying they were normal and offering more goods. 'He would grab my breasts, my butt... Flor Escilda told me that was normal, I said no, I was scared,' the now young woman testified in the oral trial.
The First Criminal Circuit Judge of Neiva deemed the victim's account 'coherent, detailed, and without hesitation,' supported by the grandmother's testimony, who initially rejected Flor Escilda's offers to take the girl. The prosecution proved the conducts involved persistent requests for sexual exchange for in-kind payments.
Both were found co-authors of aggravated sexual acts with a minor under 14 and aggravated demand for commercial sexual exploitation of a person under 18. The judge ordered their immediate capture, suspended until the sentence is final.
