The National Association of Circuit Magistrates and District Judges of the Federal Judiciary (JUFED) asked the Supreme Court of Justice of the Nation (SCJN) not to tax inherited AFORE resources with income tax.
JUFED’s position came in the context of Contradiction of Criteria 49/2026 that the SCJN Pleno will analyze.
The organization maintained that retirement savings form part of workers’ patrimony and their transfer to beneficiaries aims to economically protect families.
JUFED warned that the Judiciary should not design tax policies and that power belongs to the Legislative branch.
President Claudia Sheinbaum rejected Minister Lenia Batres’ proposal to tax inheritances and inherited AFORE resources.
