Wisconsin man faces delayed trial in baby abuse case

David Schmies, a 27-year-old Wisconsin man, will wait longer for his trial on charges of physically abusing a 3-month-old baby in 2022. Court documents show the infant suffered multiple fractures and other injuries. Schmies has rejected a plea deal.

The case involves injuries discovered on December 13, 2022, when a relative found the baby with poor coloring and a swollen head at a home in Portage County. Medical staff reported bruises across the body, 15 rib fractures likely from squeezing, leg fractures from yanking, a skull fracture, and brain bleeding. Schmies allegedly claimed the baby fell from a bed, a statement disputed by doctors.

Schmies, then 22, was arrested and charged with physical abuse of a child involving repeated acts causing harm. He is currently held at Kettle Moraine Correctional Institution on unrelated charges.

His trial, previously set for August 31, has been delayed multiple times. A pretrial hearing is now scheduled for August 12.
