A judge in Neiva sentenced Alix Tatiana Arias Rivas to 20 years in prison for inducing a 12-year-old girl into prostitution, and José Fabier Calderón Pinzón to 32 years for sexual abuses against the minor in Algeciras, Huila. The incidents took place between October and November 2022, involving payments in cash and a cell phone. In addition to prison terms, they are barred from approaching the victim and working with children.
In October 2022, Alix Tatiana Arias Rivas, acting as caregiver to a 12-year-old girl in Algeciras, Huila, started visiting the child's home under the pretext of checking on her grandmother's health. The girl lived with her grandmother, while her mother faced health issues limiting her ability to provide. Arias Rivas convinced the mother to let the girl work with her selling empanadas and oatmeal on the streets, and soon took her to live in her house in the Las Villas neighborhood for household chores.
Soon, Arias Rivas urged the girl to use birth control to avoid pregnancies, presenting herself as the caregiver at a hospital where the procedure was authorized. The woman began introducing her to men, claiming it would allow her to earn money. On October 26, 2022, the girl was taken to the home of José Fabier Calderón Pinzón's mother, where he had carnal access to her for the first time, giving her 600,000 pesos. There were two more encounters by November 24, with payments of 200,000 and 50,000 pesos, and a cell phone as a gift in the fourth meeting, which did not involve sex.
The Seventh Penal Circuit Judge of Neiva, after reviewing testimonial and documentary evidence from the Prosecutor's Office, found Arias Rivas guilty of pimping with a minor under 14, sentencing her to 240 months in prison and a fine of 162.6 minimum wages. Calderón Pinzón received 384 months for commercial sexual exploitation and abusive carnal access with a minor under 14. The judge noted the consistency in the girl's testimony, who clearly identified Calderón as the only one involved in the three accesses. “Regardless of any financial gain from offering the minor, what is punished is facilitating the child in a form of exploitation,” the judge stated in the ruling. Both individuals are prohibited from approaching the victim and from roles involving minors.
