The Audiencia de Barcelona has confirmed the archiving of the case against Badalona mayor Xavier García Albiol for revealing medical data of a homeless man who died in 2024.
In a ruling issued on May 27, 2026, the eighth section of the Audiencia de Barcelona upheld the instructor's decision. The judges noted the absence of specific data protection violations, according to the investigation by the Catalan Data Protection Authority.
The man, identified as V., visited the Municipal Hospital of Badalona on May 25, 2024 and died on June 9 of that year. During a municipal plenary session a month later, Albiol read details of his diagnosis and treatment in response to neighborhood complaints.
The court indicated that no evidence was provided of harm to the deceased's privacy or of family interest in Spain. The resolution rules out criminal law acting where the specialized authority found no violations.
