Audiencia de Barcelona archiva caso contra alcalde de Badalona

La Audiencia de Barcelona ha confirmado el archivo del caso contra el alcalde de Badalona, Xavier García Albiol, por revelar datos médicos de un hombre sin hogar fallecido en 2024.

En un auto emitido el 27 de mayo de 2026, la sección octava de la Audiencia de Barcelona ratificó la decisión del instructor. Los jueces señalaron la ausencia de infracciones concretas en materia de protección de datos, según la investigación de la Autoridad Catalana de Protección de Datos.

El hombre, identificado como V., acudió al Hospital Municipal de Badalona el 25 de mayo de 2024 y falleció el 9 de junio de ese año. Durante un pleno municipal un mes después, Albiol leyó detalles de su diagnóstico y tratamiento en respuesta a críticas vecinales.

El tribunal indicó que no se aportó evidencia de perjuicio a la intimidad del fallecido ni de interés de familiares en España. La resolución descarta que el derecho penal pueda actuar donde la autoridad especializada no halló violaciones.
