Former president José Luis Rodríguez Zapatero has filed several appeals before the National Court questioning the origin of evidence in the Plus Ultra case.
Zapatero's defense, led by Víctor Moreno Catena, requests clarification on the legality of the mobile phone seized from Rodolfo Reyes, former owner of the airline. The device was handed over by the US agency Homeland Security Investigations to Spanish police.
The lawyer argues that American authorities authorized its use but not its incorporation into judicial proceedings. He also seeks information on the resolution that allowed analysis of the Crucial hard drive seized from lawyer Miguel Palomero de Juan.
The appeals focus on possible rights violations due to lack of traceability and judicial authorization for this evidence. The entries and searches that originated part of the material took place on October 24, 2024, under orders from France and Switzerland.
