Le Conseil consultatif déclare nulle la licence de construction de l'hôtel El Algarrobico

Le Conseil consultatif d'Andalousie a statué que la licence de construction de 2003 de l'hôtel El Algarrobico est nulle et non avenue. Cet avis ouvre la voie à sa démolition après deux décennies de batailles juridiques.

L'avis, daté du 21 mai, conclut que la licence accordée par le conseil municipal de Carboneras autorisait la construction sur des terres protégées non urbanisables et portait atteinte à la zone de servitude littorale. L'organe consultatif renvoie désormais le dossier au conseil municipal afin qu'il puisse annuler formellement le permis dans un délai de 15 jours.

Le gouvernement régional andalou a exhorté le conseil municipal à porter l'affaire devant une séance plénière dans les meilleurs délais. Rocío Díaz, ministre régionale par intérim, a décrit cet avis comme « la dernière étape administrative majeure » restant à franchir avant de procéder à la démolition et à la restauration du site.

Greenpeace a salué cette décision. Eva Saldaña, directrice exécutive de Greenpeace Espagne, a déclaré que cette décision marque « la fin de l'impunité sur nos côtes ». Luis Berraquero, coordinateur en Andalousie, a affirmé qu'« il est temps que les engins entrent en action ».

Le gouvernement central a demandé la convocation immédiate de la commission de suivi, dans le cadre de son accord avec le gouvernement régional, afin d'aborder la question de la démolition. Le délégué du gouvernement en Andalousie, Pedro Fernández, a noté que l'objectif est d'exécuter « un mandat judiciaire ».
