Court suspends decision allowing Uber motorcycle taxi in São Paulo

The São Paulo Court of Justice suspended on Friday (24) the judicial decision that authorized motorcycle transport services in the capital. The city government had appealed citing risks to road safety.

Desembargador Dimas Borelli Thomaz of the 13th Public Law Chamber granted suspensive effect to the city government's appeal. He argued that the prior authorization lacked sufficient legal weight to override the fundamental right to life and road safety.

Mayor Ricardo Nunes (MDB) said the ruling prioritizes protecting lives. "Many lives will be saved," he told Folha after the court win.

Judge Patrícia Persicano Pires had given the city 48 hours to credential Uber, under a daily fine of R$ 5,000. In January, STF minister Alexandre de Moraes had already struck down restrictions in the municipal decree on the service.

Uber did not respond on whether it plans to appeal. 99 abandoned the service in April and now focuses on deliveries.
