A senior National Government Constituencies Development Fund official and a private contractor were convicted on Friday in Malindi over irregularities in a Ksh19 million public project.
The Malindi Chief Magistrate’s Court found the NG-CDF constituency fund account manager and the contractor guilty after the prosecution presented evidence from more than 10 witnesses. The official was convicted for approving a tender for an education office block without obtaining the required professional opinion under procurement rules.
The Director of Public Prosecutions stated that the official was fined Ksh400,000 or six years in prison if unpaid. The contractor was convicted on three forgery counts and one count of presenting a false document, receiving fines of Ksh200,000 per count or two years in prison on each, to run concurrently.
Both convicts were granted 14 days to appeal the convictions and sentences. The case forms part of ongoing scrutiny of NG-CDF fund management.
