A petition has been filed at the Milimani High Court challenging the appointment of Adan Abdulla Mohamed as Kenya Revenue Authority Commissioner General just hours after it was announced.
The petition, filed on May 19 at the Milimani High Court in Nairobi, seeks to stop the implementation of the appointment made via a special gazette notice dated May 18.
Justice Gregory Mutai issued directions requiring the petitioner to serve documents by May 20, with respondents filing responses by 5pm on May 22 and skeleton submissions due by May 26. The hearing is scheduled for May 27.
The challenge centers on Mohamed's age, with public records showing he was born in December 1963 and is approximately 62, exceeding the mandatory retirement age of 60 for public officers under Regulation 70. The petitioner argues the appointment is illegal and void, citing violations of constitutional provisions on leadership and integrity.
Mohamed replaces Humphrey Wattanga, who was appointed Kenya's High Commissioner to Australia, for a three-year term. The new commissioner brings experience from key financial institutions and prior service as a Cabinet Secretary under Uhuru Kenyatta.
