The Attorney General and Finance Minister have asked the High Court to halt proceedings in a case challenging the validity of Sh7 trillion in public debt.
On June 25, 2026, Justices Francis Gikonyo, Roselyne Aburili and Moses Ado dismissed the Attorney General’s argument that the case violated constitutional rules. Attorney General Dorcas Oduor and John Mbadi filed a notice of appeal on June 30, 2026, and now seek to stay the hearing scheduled for October.
Government lawyer Samwel Kaumba stated, “If the case on this matter is not stayed, the intended appeal will end up being an exercise in futility.” The suit was filed by Busia Senator Okiya Omtatah and eight other petitioners.
The petitioners challenge Sh6.95 trillion in public borrowing between financial years 2014/15 and 2023/24, including Eurobonds, and seek accountability of public officers under Article 226 of the Constitution.
