The Court of Appeal has lifted an injunction blocking implementation of a $1.6 billion health cooperation agreement between Kenya and the United States signed in December 2025.
A three-judge panel removed the order that had halted the agreement until a full hearing on October 30, 2026. Attorney General Dorcas Oduor and the Ministry of Health told the court that the suspension had created a major gap in the health sector as infectious diseases such as HIV, tuberculosis and malaria continue to rise.
The government explained that the system will help buy medical equipment, increase drug supplies, hire health workers and expand insurance coverage. The United States has committed the funds over five years.
Senator Okiya Omtatah and the Consumer Federation of Kenya (COFEK) opposed the pact, claiming it violated the constitution and risked leakage of health data. The government assured that only general information would be shared and no personal details would be released.
