Suprema Corte suspende restrições a símbolos patrióticos na campanha de Abelardo de la Espriella

A Suprema Corte de Justiça suspendeu provisoriamente as restrições que impediam o candidato presidencial Abelardo de la Espriella de utilizar a bandeira colombiana e o slogan “Firmes por la Patria” em sua campanha.

A Sala de Cassação Laboral admitiu um pedido de tutela apresentado por De la Espriella e seu advogado Germán Calderón España. O tribunal constatou que a medida cautelar emitida pelo Tribunal Superior de Bogotá apresentava deficiências em sua fundamentação jurídica.

O magistrado Víctor Julio Usme observou que a restrição afeta os direitos políticos do candidato e as condições do processo eleitoral a poucos dias do segundo turno. De la Espriella obteve o primeiro lugar no primeiro turno das eleições presidenciais em 31 de maio.

Outra tutela admitida pela magistrada Marjorie Zúñiga chegou à mesma conclusão. A investigação no Conselho Nacional Eleitoral prossegue sem uma decisão final.
