Oberster Gerichtshof setzt Einschränkungen für patriotische Symbole im Wahlkampf von Abelardo de la Espriella aus

Der Oberste Gerichtshof hat die Einschränkungen, die den Präsidentschaftskandidaten Abelardo de la Espriella an der Verwendung der kolumbianischen Flagge und des Slogans „Firmes por la Patria“ in seinem Wahlkampf hinderten, vorläufig ausgesetzt.

Die arbeitsrechtliche Kassationskammer ließ eine von De la Espriella und seinem Anwalt Germán Calderón España eingereichte Tutela-Klage zu. Das Gericht stellte fest, dass die vom Oberlandesgericht Bogotá erlassene einstweilige Verfügung Mängel in ihrer rechtlichen Begründung aufwies.

Richter Víctor Julio Usme merkte an, dass die Einschränkung die politischen Rechte des Kandidaten sowie die Bedingungen des Wahlprozesses nur wenige Tage vor der Stichwahl beeinträchtige. De la Espriella erreichte in der ersten Runde der Präsidentschaftswahl am 31. Mai den ersten Platz.

Eine weitere von Richterin Marjorie Zúñiga zugelassene Tutela-Klage kam zu demselben Schluss. Die Untersuchung beim Nationalen Wahlrat dauert an, eine endgültige Entscheidung steht noch aus.
