Leire Díez seeks to annul case over disproportionate detention

Leire Díez's defense has asked judge Santiago Pedraz to annul the entire case, arguing her December 2025 detention violated fundamental rights. Two PSOE workers have also appealed the seizure of their mobile phones.

Leire Díez's defense filed a motion before Audiencia Nacional judge Santiago Pedraz to annul the entire case. It argues the December 2025 detention was “completely disproportionate, unjustified” and lacked judicial authorization.

The filing links the arrest to UCO searches in a separate case against businessman Antxon Alonso. It states the facts were generic and questions why a voluntary summons was not sufficient.

Two PSOE employees charged in the same case appealed Pedraz's decision to uphold the May seizure of their phones. They claim agents acted without a specific judicial warrant for their homes and without legal assistance.
