Mombasa High Court rules second wife inherits Sh200 million estate

The High Court of Mombasa has ruled that Bi R.B is the lawful wife of the late Prem Lal Ramnath and entitled to inherit his estate valued at over Sh200 million.

The ruling came in an inheritance dispute pitting Bi R.B against Bi A.G and her children. The court found the first marriage had ended when Bi A.G moved to Canada in 2001 and did not return until after the death of Prem Lal Ramnath on November 24, 2019.

Bi R.B married the deceased in Mombasa in 1999. She lived with him for nearly 20 years and donated a kidney in 2012 to save his life. The court dismissed fraud claims and confirmed she was his wife at the time of death.

The court held that divorce can be deemed to have occurred when couples live separate lives even without a formal order. It refused to annul Bi R.B's marriage and allowed her to apply for letters of administration.
